A Case That Stands Out–A Message From Tom Carey

There was one case I had years ago that I am really very proud of.   Over 30 years ago, the death of a young girl by a drunk driver on the Courtney Campbell Causeway.  The driver had crossed the center median line and caused the crash that killed the client. In the processing of that case, I hired a traffic engineer  who told me that both Hillsborough County and Pinellas County were violating Federal Law because at the time there was no center barrier on the causeway, just yellow lines.  I researched the issue and came to learn that the Pinellas and Hillsborough County  Commissions decided to pull out the then existing barrier because they were concerned that trash and refuse would pile up against it, making the road look unattractive to tourists.  I decided to include both agencies as defendants to this lawsuit, for contributing to the death of this young woman.  The case proceeded on for a year and a half and settled before trial, but part of the settlement was that the family of the victim got a promise that the federally mandated center barrier would be re-installed, which it now is.  As a result, many more people are alive today because our law firm took on the government  and forced them to do what was required and what was right.
