Board Certified Trial Lawyer versus non-Board Certified Trial Lawyer
If you were injured in any type of accident that wasn’t your fault, or have had the terrible experience of losing a loved one due to someone else’s negligence, you should care whether your lawyer is Board Certified in Civil Trial Law.
The legal field is different from certifications in other professions. For example, most doctors are board certified in their particular area of expertise. In the legal field, however, Board Certification is actually quite rare. In fact, less than 2 % of Florida’s lawyers are board certified Civil Trial lawyers.
You see, in the legal field Board Certification isn’t something that’s required. In order to be Board Certified in Civil Trial Law, a lawyer has to satisfy several requirements. They must be a lawyer for at least 5 years. They have to dedicate a certain amount of their practice to civil trial work, and have taken at least 15 cases to trial within recent years. They must have spent at least 55 hours in specific Continuing Legal Education courses. Judges and other lawyers are interviewed about their qualifications and skills, and finally, they have to pass a very challenging exam. It’s an extensive process.
You can be sure that if your lawyer is Board Certified, you’re in good hands. He or she knows what they are doing, understands the applicable laws and rules, and knows how to conduct a trial. You should trust their advice.
Don’t assume that because your lawyer’s billboard or commercial says “Trial Lawyer” that they are Board Certified, or that they have ever even been in an actual courtroom. Ask them if they are Board Certified. If you feel uncomfortable asking, you can find out from the Florida Bar. If your lawyer is NOT Board Certified, ask them if they are supervised by a lawyer who is. If your lawyer is not yet Board Certified but working towards certification and under the supervision of an attorney who is already Board Certified, you are in very good hands.
If your lawyer isn’t supervised by someone who is Board Certified, you need to ask some more questions. How many cases has your lawyer taken to trial? Have they ever actually filed a lawsuit? If they tell you they have not, regardless of the reasons, that is not a good sign. You don’t want a lawyer who isn’t experienced with lawsuits to force you to settle because he doesn’t know how to go to trial, or can’t afford to litigate. And trust us, the insurance companies know which law firms take cases to trials and which ones always settle. The law firms that go to trial generally get more respect, and therefore higher offers, from the insurance companies.
At Carey and Leisure, all four of our partners are Board Certified in Civil Trial Law in the state of Florida, and partners Thomas Carey, Jodi Leisure and Michael Walker are also certified nationally. Our younger attorneys are all supervised by our Board Certified partners, and are all working toward their Board Certification.

We Take Cases to Trial
Insurance companies recognize the lawyers who will “go to bat” for their clients and “take it all the way”. Likewise, insurance companies also know which the lawyers who would rather settle a case despite it being worth more than the insurance company’s “top offer”. Getting the best possible results for your case includes having a lawyer with a great reputation who is not afraid to take on the BIG insurance companies. We are not afraid to take cases to trial. This fact forces the insurance companies to take our demands seriously. The insurance companies know which lawyers never take cases to trial, and as a result they often make lower, unfair offers to the clients represented by those lawyers. At Carey and Leisure, while many cases do settle, we prepare every case as if it is headed to trial, and the insurance companies know it.
You will be hiring a TEAM of attorneys
At Carey and Leisure, we work together as a tenacious team of lawyers. We stratagize together to develop the best plan of action for each of our client’s needs. This communal thought process and idea sharing maximizes success for our clients. We’ve used this method to approach all of our cases for years, and it works. We have handled over 50,000 car crash cases.
We “wrote the book” on personal injury claims in Florida
Our partners, Thomas Carey, Jodi Leisure and Katherine Neal are authors of “A Conversation with Our Clients”. This book was written so that our clients can understand the civil justice system and be better informed about what to expect during the claim process, litigation and trial process. Our book takes the reader step-by-step through a case, and gives great insight on what occurs after an accident. All of our clients are given this book upon retaining our firm. If you are interested in obtaining a copy of this book, please contact us at 800-927-0400.

Available 24/7 and you will have our personal cell phone number
While Carey and Leisure does employ the best and brightest paralegals in the field, you will not be talking to “just your paralegal” about your case. You will have your lawyers’ personal cell phone number. We are available to our clients 24/7. We know that after a car crash, you feel overwhelmed due to pain, medical bills, lost wages and endless phone calls and letters from the insurance company. Once you become our client, we take the load off, so that you can feel as stress-free as possible, communicate with us whenever you need to, and concentrate on healing.
Excellent Customer Service
At Carey and Leisure, we believe in the personal touch. Every potential new client meets with a lawyer, not a paralegal or an investigator. After all, lawyers are the only people who should be giving legal advice. It is important to meet with an actual lawyer in the early stages of your case to make sure that your rights are protected, and the excellent service doesn’t stop when you sign a contract and become our client; at Carey and Leisure, you are not just a file number. We try our very best to treat you like family. Throughout the entire process, you will be kept informed, receive emails and calls from your lawyer and your paralegal, and always have your questions answered promptly.
You do not pay us unless we win
We work on a contingency fee agreement which is based on our case results. If we do not obtain a settlement or judgment for you, we do not receive a fee. We get paid only when we are successful in achieving results for our clients.
