Summary.

Based on the facts of the case before it, the First District Court of Appeal held that a trial court erred in granting
an injunction for prevention of domestic violence against the
parents of a woman who had mental health problems. The First
District held that neither (1) the filing of a Baker Act petition by the
parents, (2) uncivil conduct by them in initiating confrontations with the daughter’s case manager and doctors, nor (3) repeated unwanted phone calls by the parents to the daughter, supported finding that the daughter possessed objectively reasonable fear of malicious behavior of the type needed to grant a domestic violence injunction.
